What personal data does IMAP Netherlands process?

IMAP Netherlands processes personal data that you have provided to us, personal data generated during your visit to our website and while reading newsletters, and personal data we have derived from other sources.

Provided to IMAP Netherlands by you:

  • Contact details and other personal data that are necessary for handling your case;

  • Personal data you provide to IMAP Netherlands in the context of events, seminars, meetings and newsletters for which you have registered.

  • Data concerning the device you used to visit our website, for example your IP address;

  • Personal data received from public online sources such as company websites, Mergermarket, and social media platforms such as LinkedIn;

  • Other personal data relating to you that we obtained in handling cases via (inter alia) clients and market studies.


Why does IMAP Netherlands process your personal data?

IMAP Netherlands uses your personal data for several purposes:

  • To provide corporate finance services performed by our consultants for our clients;

  • To comply with our statutory obligations such as obligations under the Money Laundering and Terrorist Financing (Prevention) Act (Wet ter voorkoming van witwassen en financieren van terrorisme, WWFT);

  • To contact and communicate with you;

  • To perform marketing activities, such as sending newsletters and other forms of marketing communications that may be of interest to you;

  • To improve the quality of our services;

  • To conduct customer satisfaction surveys.


The protection of your data

IMAP Netherlands has taken appropriate technical and organizational measures to protect your personal data against loss or against any form of unlawful processing. People who have access to your data or files on IMAP Netherlands’ behalf have a duty of confidentiality. IMAP Netherlands uses technological and operational security standards that are generally accepted in the sector in order to protect personal data from being lost, misused, altered or destroyed. Engaging third parties/ sharing data with third parties 

In certain cases it may be necessary for IMAP Netherlands to give third parties access to personal data. A non-exhaustive overview is provided below:

  • Third parties, such as regulators and other organizations, in order to comply with our statutory obligations;

  • External suppliers in connection with the processing of your personal data for the purposes described in this Privacy Statement, such as ICT suppliers, suppliers of communication services or other suppliers to whom we outsource certain support services.

The transfer of your personal data to the abovementioned third parties will only take place for the purposes mentioned in this Privacy Statement.

Third parties to whom we provide your personal data may themselves be responsible for complying with privacy legislation. IMAP Netherlands is neither responsible nor liable for the processing of your personal data by these third parties. To the extent that a third party processes your personal data as a Processor of IMAP Netherlands and therefore acts at the request and on the instructions of IMAP Netherlands, IMAP Netherlands concludes a processing agreement with such third party which meets the requirements set out in the Regulation.

Data outside the European Union

In order to provide our services, it may be necessary for IMAP Netherlands to transfer your personal data to a recipient in a country outside the European Union. In that case IMAP Netherlands ensures that such data transfer is in accordance with the Regulation.

Purposes for the processing of personal data

IMAP Netherlands may process personal data for a number of purposes. The data processing may be necessary to perform a contract for the provision of corporate finance services or to comply with a statutory requirement. In some cases we will ask for your explicit consent, for example for the use of certain cookies, or, if you are not a client, for receiving commercial communications.

Data may also be processed in connection with a justified interest of IMAP Netherlands, for example for the purpose of internal administration, effective communications, quality improvement or direct marketing for clients and active contacts of IMAP Netherlands. In the latter case, an opt-out is always offered.

Retention period

IMAP Netherlands will not retain your personal data any longer than is necessary for achieving the purposes stated in this Privacy Statement or for complying with statutory retention periods.

Your rights

You have the right to ask IMAP Netherlands to correct, supplement, delete or block your personal data if it is incomplete, incorrect or is being processed in contravention of any statutory provision. You also have the right to request IMAP Netherlands to inform you of any personal data it holds relating to you. If you no longer wish to receive newsletters, emails or invitations to seminars or events, you can unsubscribe at any time and at no cost by sending an email to info@imap.nl.

You also have the right to object to the processing of your personal data. IMAP Netherlands will discontinue the processing if it is required by law to do so. IMAP Netherlands will continue with the processing if there are justified imperative grounds to do so that outweigh your interests, rights and freedoms.

Complaints procedure

At IMAP Netherlands we attach great value to the quality of our work and the satisfaction of our customers with the services we provide. That is why we regularly survey customer satisfaction levels and use the results to further improve our services. If you feel that aspects of our services could be improved, please bring it to the attention of your IMAP Netherlands consultant. We will take all the steps necessary to resolve the matter to your satisfaction. If you still feel the matter has not been resolved, you can use our complaints procedure. In addition, you have at all times the right and the option to submit a complaint about IMAP Netherlands’ processing of personal data to the Dutch Data Protection Authority.

Statement is subject to change

IMAP Netherlands reserves the right to amend or alter this Privacy Statement if, for example, there are changes to the processing or if legislation changes. If there are substantial changes, IMAP Netherlands will notify you of this. Nothing in this Privacy Statement is intended to create any obligation or cause any agreement to be concluded between IMAP Netherlands and any visitor to this Internet site or to provide any information in that context.

IMAP Inc, ("IMAP") is made up of different legal entities and partnerships registered in different jurisdictions, some of which are limited liability entities.

Where we process your personal data during your website visits, IMAP Inc. Sucursal en España is responsible for processing your personal data. 

IMAP does not act as controller in the following situations:

Personal data processed in connection with a contractual relationship or upon entering into a contractual relationship with a specific IMAP company. In this case, the person responsible for personal data is the IMAP contracting company, which is the company with which you or your employer have entered into or will contract.
 

Personal data collected at the physical location of an IMAP country company. In this case, this national company is the person responsible for the personal data.

WHAT INFORMATION DO WE COLLECT FROM YOU?
Personal data means any information about an individual from which that person can be identified. It does not include data which has been anonymized such that a person's identity is removed.

We may collect, use, store and transfer different kinds of personal data. The categories of personal data which we process include:

Contact Data such as names, job titles and other identifiers together with addresses, e-mail addresses and telephone numbers.
Technical Data including internet protocol (IP) addresses, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website. This may also include information about how you use your website and our services.
Marketing Data includes marketing and communication preferences and data used for networking and business development such as employment history, role and information about personal interests
 

THE PURPOSE AND LEGAL BASIS OF PERSONAL DATA PROCESSING
To receive our publications, marketing materials, event invitations and news about IMAP you may be required to complete a subscription.

This information you provide in the subscription enables us to process your subscription. If you do not provide this information, we will regrettably be unable to process your subscription/event registration. Furthermore, you will not be able to attend our events or receive information from us in accordance with the areas you are interested in unless there is a legitimate interest of IMAP in which case your subscription is not required.

The legal basis for processing your data for the purpose specified in this section is the consent given in accordance with section 6 of this Policy, as well as the legitimate interest of IMAP.

IMAP has a legitimate interest in contacting existing and potential clients and business contacts with information about our services and other news which we believe may be of interest to you, as well as event invites.

In our legitimate interests of providing the best service and developing our business, we will process information in order to:

provide you with a personalized service
provide you with information on market trends and opportunities
improve our services
keep our site and systems safe and secure
understand our clients and their business objectives
update and enhance client records
defend against or exercise legal claims and investigate complaints

The personal data you provide in relation to receiving our publications, marketing materials, event invitations and news is processed with your explicit and unequivocal consent. Additionally, to understand what areas are of interest and how we can improve our content, we process your personal data related to your interaction with the e-mails we send to you. We do this for statistical/performance purposes. You provide this consent by clicking "Subscribe to newsletter" on the subscription.

You can opt out of receiving electronic communication from us and of processing your interactions with us at any time by clicking the unsubscribe link in the communication you receive from us or by contacting us at gdpr@imap.com. In such a case, we will stop using the data for electronic communication or measurement of interactions. Such withdrawal does not affect the legality of the operations for processing of your personal data prior to it. You may still receive e-mails directly from IMAP staff and employees you are in touch with based on the legal grounds applicable for the case (e.g. performance of a contract).

 

YOUR RIGHTS
In accordance with the relevant provisions, you have the right to access, amend, delete, port your data, restrict and object the processing of your personal data.

If you would like to exercise any of these rights, please contact us at gdpr@imap.com. Your request will be analyzed and answered within one (1) month from receipt by us, in accordance with the law.

TRANSFER OF DATA
As an international group we share information between our offices, a list of which is available here and is updated as necessary, and your personal data is made available to them. Some of these offices are located outside the European Economic Area (EEA) and the laws in these countries may not provide the same level of protection as in countries within the EEA. However, all our offices at all times will ensure a level of data protection at least as protective as that required in the EEA. We may also instruct third party suppliers to perform services such as software support, e-marketing campaigns, hosting our website, etc. on our behalf. In such cases we take the necessary contractual steps to ensure the adequate protection of your personal data. Your personal data will not be given to other third parties, apart from in limited circumstances such as when we host a joint event with a third party and you register to attend it. In such cases, you will be informed in advance that this is a joint event and if you register to attend it, your contact data will be shared with the other event organizers.

Forwarding the communication you receive from us: To improve your experience, we personalize the e-mails we send you and all links within them.
